2. Introduction and Acceptance

By using the websites and mobile applications, including but not limited to https://outcy.com/ (collectively, the "Site"), provided by EVENHERO LTD and its affiliates (collectively "EVENHERO LTD", "we", or "us"), you expressly agree to be bound by the following Terms of Use (the "Terms"). We reserve the right to update and make changes to these Terms at any time. Your continued use of the Site after any changes indicates your unconditional acceptance of the modified terms.

3. Permitted Use and Account Registration

3.1 Age Restrictions and Legal Capacity

4. Public Health, Infectious Disease, and COVID-19 Waiver

You expressly acknowledge that an inherent risk of exposure to COVID-19, its variants, and other infectious or communicable diseases exists in any public place where people gather, regardless of whether the Event is indoors or outdoors. By purchasing a ticket and attending an Event, you voluntarily assume all risks, hazards, and dangers arising from or relating to such exposure, whether occurring before, during, or after the Event.

(b) Compliance with Health Policies: You agree to comply strictly with all health and safety protocols, guidelines, and mandates implemented by EVENHERO LTD, the Event organizer, the venue management, and relevant governmental authorities (including those of the Republic of Cyprus or the specific jurisdiction where the Event is held). These requirements may include, but are not limited to, wearing face coverings, providing proof of vaccination or negative test results, and submitting to health screenings. Failure to comply with these policies may result in refusal of admission or immediate ejection from the Event without any right to a refund.

(c) Waiver and Release of Liability: To the maximum extent permitted by applicable law, you hereby absolutely and irrevocably waive, discharge, and release EVENHERO LTD, its directors, employees, affiliates, Event promoters, and venue operators from any and all claims, demands, liabilities, causes of action, or damages arising out of or relating to any exposure to, or illness contracted from, an infectious disease connected to your attendance at an Event.

5. Acceptable Use Policy

When using the Site, you agree that you will comply with applicable law, provide truthful information, and conduct yourself respectfully. Furthermore, it is a condition precedent to our authorizing your access to the Site that you will NOT do any of the following:

  • Use any robot, spider, site search/retrieval application, or automatic device to access our Site for any purpose without our express written permission (e.g., to retrieve, index, or "data mine").
  • Use automated ticket purchasing software (e.g., ticket bots) or tools to search for, reserve, or buy tickets, or to circumvent any security measures or access controls.

  • Order, or attempt to order, a number of tickets for an event that exceeds the stated limit for that event.
  • Reproduce, decode, decrypt, or reverse engineer any Tickets or underlying algorithms or barcodes.
  • "Frame", "mirror", or deep link to any part of the Site without prior express approval from EVENHERO LTD.
  • Take actions to interrupt, damage, disable, overburden, or limit the functionality of the Site, software, hardware, or servers.

6. Ownership of Content and Intellectual Property

Logos, trademarks, and service marks found on this Site are the property of EVENHERO LTD or its licensors, promoters, venues, or artists. The software, code, images, and data on this Site are protected by copyright and other intellectual property rights. 7. User Content and Submissions

9. Specific Service Terms

Event Tickets

EVENHERO LTD acts exclusively as an intermediary for Third Party Providers (organizers/promoters). Prices, availability, and the possibility of cancellation or modification are determined exclusively by the Provider. Pursuant to the Cyprus Consumer Rights Law (Law 133(I)/2013), the right of withdrawal is explicitly excluded for services related to leisure activities that provide for a specific date or period of performance. Therefore, tickets cannot be returned or refunded unless the event is cancelled.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. EVENHERO LTD, ITS AFFILIATES, PROMOTERS, AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOUR ACCESS TO THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, NOR ARE WE RESPONSIBLE FOR THE PERFORMANCE OR QUALITY OF ANY EVENT, PROMOTER, OR VENUE.

11. Limitation of Liability

"Force Majeure" means any cause beyond our control including, without limitation, acts of God, war, insurrection, acts of terrorism, fire, flood, weather, pandemics, epidemics, national defense requirements, or actions taken by governments. We will not be liable for the failure to perform any obligation under these Terms caused by Force Majeure.

The Site contains products and services offered by, and links to sites owned by, third parties. These links are provided for your convenience. EVENHERO LTD makes no representations whatsoever about any other website and has no control over the content or privacy practices of Linked Sites.

15. Dispute Resolution and Governing Law

15.1 Governing Law: These Terms and Conditions, and any dispute, controversy, or claim arising out of or in connection with them, their subject matter, or their formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the Republic of Cyprus.
